Eats365 Referral Program Terms & Conditions

Effective for Qualified Referrals submitted on or after April 1, 2023

These Terms and Conditions (the “Terms”) apply to Eats365 Referral Program (the “Program”). By submitting a referral for a restaurant or otherwise participating in the Program, you agree to be bound by these Terms and Toast’s Privacy Statement.

Program Eligibility

Who is Eligible to Participate?

Eats365 customers, consultants, investors, and friends who refer a restaurant to Eats365 for point of sale and other restaurant systems (“POS services”) through the online referral form or in writing, including by email, to a Eats365 Account Executive may be eligible to receive the referral reward. 

Who is Not Eligible to Participate?

Employees of Eats365 technical integration and strategic partners with existing referral programs, including immediate family and household members;
Eats365 employees within the Sales department, including immediate family and household members;
Employees of an authorized Eats365 reseller, including immediate family and household members;
Restaurant owners, operators, or decision-makers responsible for making the POS purchasing decision referring their own restaurants;
Franchisors responsible for making the POS purchasing decision referring their own franchisees; and
Individuals who are under 18 years old.

Referral Requirements

Subject to these Terms, for each “Qualified Referral” that meets the following criteria, you will receive the applicable Bonus Payout listed below. A “Qualified Referral” is a restaurant that:

You refer to Eats365 either through the online referral form, or in writing, including by email to a Eats365 Account Executive;
is not an existing lead in the Eats365 system; and
enters into a Merchant Agreement Initial Order Form with Eats365 for POS services, and has been live, processing transactions on the Eats365 platform for at least 30 days.
Verbal referrals will not be accepted.

Eats365 reserves the right, in its sole discretion, to determine the original lead source. Exceptions may be made, in Eats365’s sole discretion, if the referral has not been contacted by Eats365 for at least six (6) months.

Reward Payouts

Referrers may be eligible to receive a reward payout for a Qualified Referral as set forth herein (the ”Reward Payout”). Eats365 customers, consultants, investors, and friends may be eligible to receive a reward in form of 3 months of free POS software license or cash amount equivalent to 2 months of POS license subscription.

The Reward Payout for a restaurant brand or group will be as follows. A restaurant brand or group is defined as either a franchise group or corporate entity and its affiliates (each “Restaurant Group”). For the first location in a Restaurant Group, the referrer may be eligible to receive the full Bonus Payout as set forth above. For the second through the fifth locations in a Restaurant Group, the referrer may be eligible to receive half of the Bonus Payout. For the sixth location and onward locations in a Restaurant Group, the referrer may be eligible to receive a 1/3 of Reward Payout per shop. For illustrative purposes only, if a Eats365 customer submits Qualified Referrals for five locations in a restaurant group, the total Reward Payout amount would be 9 months of POS license or cash amount equivalent to 4.5 months of POS license.

Eats365 will determine, in its sole discretion, whether a referral is a Qualified Referral eligible for a reward payout and reserve the right to disqualify any referrer at any time for any reason from participation in the Program for reasons including but not limited to Eats365’s good faith belief that referrer has violated these terms. Subject to the terms herein, there is no limit to the number of referrals an individual can submit, or eligible reward payouts for Qualified Referrals an individual may receive, while the Program is in effect. Each Reward Payout will be made by direct deposit. Referrer must enroll in the Eats365 Referral Program Portal (“Referral Portal”), in order to receive the Reward Payout and timely payment of the Reward Payout is dependent on timely enrollment in the Referral Portal.

If a referrer does not enroll in the Referral Portal and provide the information needed to receive a Reward Payout within one year after submitting a Qualified Referral, the referrer shall not receive a Bonus Payout for that Qualified Referral.

Modifications

Eats365 reserves the right to modify these Terms or terminate the Program at any time, in its sole discretion, without notice.
